2. SUBJECT OF THE CONTRACT

The subject of this contract is the determination of the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, regarding the sale, collection, delivery, and installation commitments within Istanbul of the children's furniture product(s) whose characteristics and sales price are specified below, and which the Buyer ordered electronically from the Seller's website.

3. PRODUCT, PAYMENT AND COLLECTION INFORMATION SUBJECT TO THE CONTRACT

3.1. Product Information

3.2. Payment and Collection Transactions (iyzico)

  • The price of the product subject to this contract is collected from the Buyer's credit card/bank card by the Payment Service Provider iyzico (İyizi Ödeme ve Elektronik Para Hizmetleri A.Ş.) on behalf of the Seller.
  • The Buyer accepts that in case of cancellation and return, the refund will be made to their card in a single payment via iyzico, and that the Seller cannot be held responsible for delays caused by bank and iyzico processing times.

4. DELIVERY, LOGISTICS AND INSTALLATION TERMS

  • 4.1. Delivery Time:
    Considering the production, preparation, and logistics processes of children's furniture products, the delivery time cannot exceed 30 days from the moment the Buyer approves the order, in accordance with the regulations.
  • 4.2. Voluminous Product Delivery:
    The transportation of furniture products with high volume and weight may be carried out as delivery to the building entrance/apartment door, in accordance with the working rules of logistics companies. Floor delivery is at the discretion of the carrier company and depends on regional conditions.
  • 4.3. Damage Assessment Report:
    Upon receiving the product, the Buyer is obliged not to accept damaged products such as dents, breaks, torn packaging, etc., and to have a "Damage Assessment Report" prepared by the cargo officer. Responsibility for damaged products without a report belongs to the Buyer.
  • 4.4. Installation Service within Istanbul:
    If the delivery address is within the provincial borders of Istanbul, installation service is provided by the Seller free of charge/included in the price. Following product delivery, the Seller will contact the Buyer to schedule an installation appointment within a reasonable time.
  • 4.5. Installation Outside Istanbul:
    For deliveries to provinces outside Istanbul, assembly and installation are the responsibility of the Buyer. Installation diagrams and necessary accessories are included in the product packages. Damages resulting from incorrect assembly are not covered by the warranty.

5. RIGHT OF WITHDRAWAL AND EXCEPTIONAL CIRCUMSTANCES

  • 5.1. 14-Day Right of Withdrawal:
    For standard production children's furniture products, the Buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery of the product to themselves or the person/organization at the address they indicated, without giving any reason and without paying any penalty.
  • 5.2. Return Shipping Fee:
    In case of exercising the right of withdrawal, the return shipping/logistics fee belongs to the Seller, in accordance with current legal regulations. The Seller will provide the Buyer with the agreed carrier information and return code.
  • 5.3. Special Production Exception:
    In accordance with Article 15/1-b of the Distance Sales Contracts Regulation; the right of withdrawal cannot be exercised for children's furniture that is custom-made outside of standard mass production, based on the Buyer's chosen special color, fabric, measurements, or personal needs.
  • 5.4. Products with Completed Installation:
    For standard furniture products that have been assembled in Istanbul or installed outside Istanbul, if there is a loss of value due to use beyond normal, the Seller reserves the right to demand compensation for the loss of value legally.

6. MEDIATION AND AUTHORIZED COURT

  • 6.1. Pre-condition Information:
    In accordance with the legislation, the Buyer is informed that mediation is a legal prerequisite before filing a lawsuit in disputes arising from this contract between the parties.
  • 6.2. Authorized Authority:
    In disputes, Consumer Arbitration Committees in the Buyer's place of residence are authorized up to the legal monetary limits announced annually by the Ministry of Trade, and Consumer Courts are authorized for disputes exceeding these limits.

7. EFFECTIVENESS

The Buyer is deemed to have accepted all terms of this contract when they complete the payment process for the order placed through the website. The Seller is obliged to send this contract to the Buyer's e-mail address as a permanent data carrier (PDF or electronic text) upon completion of the order.
